Sussex Man Found Unresponsive in Grocery Store Parking Lot Faces Charges

Kevin P. OBrien, 22, of Sussex, faces criminal charges after he is accused of using heroin right before he was found slumped over in a vehicle in Pewaukee.

A Sussex man, who was found unresponsive in his vehicle in a grocery store parking lot more than a year ago, is now facing felony charges from the incident.

Kevin P. OBrien, 22, was charged Thursday in Waukesha County Circuit court with possession of heroin, possession of marijuana and possession of drug paraphernalia.

Obrien is scheduled to appear in court on the felony and two misdemeanor counts on July 29.

A vehicle with its lights on parked after hours at a grocery store on Ryan Street in Pewaukee drew the suspicion of a Pewaukee police officer on patrol June 23, 2012, according to the criminal complaint.

The officer walked up to the vehicle and noticed the driver was slumped over with his head hanging down, the complaint states. The officer banged on the window and the driver was initially unresponsive. However, a short time later, the driver looked at the officer and appeared to be confused or under the influence.

The driver, later identified as OBrien, was having difficulties exiting the car without the officer’s help. He wasn’t speaking logically, telling the officer he was tired and that he didn’t know why he was in the parking lot, the complaint states. He put his hands in his pockets and couldn’t immediately produce his driver’s license for the officer.

The officer noticed OBrien was manipulating something in his pocket, and, concerned there may be a weapon, placed his hands over OBrien’s pocket, the complaint states. The officer then located a bag of marijuana in OBrien’s pants.

Heroin and drug paraphernalia were located in the vehicle, the complaint states. The officer noticed fresh track marks on OBrien’s elbow.

OBrien admitted to using heroin and injecting it just before the officer had contact with him, according to the complaint.
