Sussex Man Charged With 4th OWI

Suspect allegedly halted field sobriety tests because he knew he wouldn't pass them when pulled over in Town of Merton.

A 31-year-old Sussex man is facing his fourth operating while intoxicated charge after he was arrested in Town of Merton on Friday with a 0.169 blood alcohol level.

Scott P. Minsaas was charged in Waukesha County Circuit Court on Monday with one count of fourth offense OWI within five years. If convicted, he faces up to six years in prison and $10,000 in fines.

According  to the criminal complaint, at 10:45 p.m. Friday Minsaas was pulled over by a Chenequa police officer on Park Road in Merton. Another driver had called in a complaint of a vehicle traveling at a high rate of speed and tailgating her on southbound Highway 83.

Minsaas told officers he had consumed four or five mixed drinks at a friend’s house prior to driving. He then halted field sobriety tests, the complaint states, because he told officers he had been drinking and would fail them.

Minsaas was previously convicted on OWI charges in 2001, 2006 and 2008. He was freed from Waukesha County Jail on Tuesday on $3,500 cash bond.
