Plea Deal Reached in Len Bias Case

Donald Ray Brown guilty of delivery of narcotics as part of deal with prosecutors and will avoid trial.

A Milwaukee man who sold drugs to a Sussex woman who later overdosed and died will not stand trial. Donald Ray Brown, 47, pleaded guilty Monday to one count of manufacture and delivery of a schedule I or II narcotic as part of a plea deal with prosecutors. The charge is reduced from reckless homicide charges under the state's Len Bias law, which he was charged with in December 2011 for selling heroin to Patricia K. Berge, 22, who later died. According to the criminal complaint: Waukesha County deputies were dispatched to Berge’s apartment in the West 23000 block of Clover Drive on June 3 around 7 a.m. after her mother, Kelly McFarlin, found her lifeless in her bedroom. Heroin Overdose: Trial Set for Reckless Homicide of Sussex Woman

The man allegedly sold the heroin that eventually killed her and is facing reckless homicide charges.

After pleading not guilty in February, the Milwaukee man facing charges for selling heroin that lead to the overdose death of a Sussex woman is about to get his trial. Donald Ray Brown, 46, will face a 12-person jury on Nov. 13 in Waukesha County Circuit Court to deterimine his fate. The trial is expected to last up to four days.  This comes after Brown, who is still in custody, unsuccessfully attempted to have his reckless homicide charges dismissed in early February. He later pleaded not guilty and has made a string of court appearances ever since.  Brown is facing 40 years in prison after he was charged with one count of first-degree reckless homicide for allegedly selling heroin to Patricia K. Milwaukee man facing 40 years in prison after being charged with selling the 22-year-old Sussex woman the drugs that killed her.

A Milwaukee man charged in the heroin overdose death of a 22-year-old Sussex woman had been selling her drugs for almost every day for more than a year, court records shows. Donald Ray Brown, 46, is facing 40 years in prison and/or a $100,000 fine after being charged in Waukesha County Circuit Court Monday with first-degree reckless homicide in the death of Patricia K. Berge. He is currently being held in jail on a $10,000 cash bond while awaiting trial. Man's Fatal Overdose Prompts Warnings of Heroin Rise

A 22-year-old Brookfield man found dead from an apparent drug overdose is one of several recent drug deaths in the county, experts say.

A 22-year-old Brookfield man's fatal drug overdose — possibly from heroin — has law enforcement and drug counselors warning parents that prescription drug and heroin use is on the rise. "There have been four very recent overdose deaths that we're aware of," said Claudia Roska, executive director of the Addiction Resource Council in Waukesha. "I'm not sure that everyone was in Waukesha County but very close." Roska said in her 24 years with the council, "this is the first time I've seen this much heroin use in Waukesha County."
