An attorney representing two Lisbon families is hoping to halt the major Sussex Meijer retail development.
Meijer developers may have finished their work with the Sussex Plan Commission, but on the same day it received final approvals from the commission a lawsuit was filed to halt the project. According to the Business Journal of Milwaukee, attorney Joe Cincotta has filed a suit with the Waukesha County Circuit Court challenging the village’s approval process. Cincotta filed the claim for Lisbon property owner Larry Pfannerstill who lives on a property near the development. Cincotta alleges that the development will damage Pfannerstill’s property value and destroy his ability to enjoy peace and quiet on his land. The Plan Commission will evaluate a use permit that contains several changes to Sussex code to clear the way for the 200,000-square-foot development.
After an unprecedented 8-hour public hearing regarding the 200,000-square-foot Meijer Store development, the Plan Commission is ready to review an unprecedented permit for the proposal. After a public hearing - separated into two evening meetings - the Sussex village staff crafted a conditional use permit for the development. The proposal contains several exceptions to the village code to accommodate the Michigan-based retailer. The Plan Commission will walk through the permit at 6:30 p.m. Thursday at Village Hall. Commissioners will discuss potential adjustments to the plan and give further direction to village staff. The Plan Commission can add more conditions to the permit if deemed necessary. Lisbon leaders voiced their opposition to the Meijer project Monday, but Sussex leaders reaffirmed support. A contentious public hearing on the project could unfold Thursday.
Leaders for Sussex and Lisbon agreed to disagree when it comes to the large-scale Meijer Foods development. Lisbon and Sussex officials met Monday during a Joint Planning Committee meeting to discuss the Meijer development rezoning, conditional uses, and land use. In a vote that was purely symbolic, Lisbon leaders unanimously opposed the development while Sussex officials voted in favor. By the end of the night, they had agreed to disagree. Lisbon town officials cited concerns over the size of the development, storm water management on the site, and facets of Meijer’s conditional use. The Village Board amended its land use map Tuesday to accommodate a Meijer store; however, the man who owns that land says village leaders overreached.
There’s no doubt the proposed 200,000-square-foot Meijer development has created a buzz amongst residents in Sussex lately. But the Schellin brothers, who own the land on which the store would be built, have concerns about their future. The Village Board on Tuesday rezoned the Schellin’s land to make way for the big-box retailer and gas station that will rest on 20 acres of the roughly 68 acre plot. Steven Schellin supports the Meijer development, but he feels the village went too far by deeming 18 acres of his land an environmental corridor, which undevelopable for future buyers. “We support the Meijer project and those changes required to be made in order to make the project a success. Cincotta is a parasite who has been hired by the Unions, Woodman's or Roundy's to stop the inevitable invasion of Meijer, a family owned, valued and operator who is a good corporate citizen.
