Controversial incumbent Kathy Nickolaus up for re-election in November 2012, but there are hints of a primary election.
Waukesha County Clerk Kathy Nickolaus may face a primary opponent if she seeks re-election in 2012. Keith Best, who is in charge of public relations with the Republican Party of Waukesha County, said in a comment on Patch that not all area Republicans are happy with her performance. "Nickolaus will be primaried," Best wrote in the comment. "Once again the voters will decide." Nickolaus made national news this spring when she failed to release the City of Brookfield's results from the hotly contested state Supreme Court race between David Prosser and JoAnne Kloppenburg. Assistant State Attorney General Joanne Kloppenburg conceded election Tuesday to incumbent David Prosser Jr., saying the widespread anomalies found during a historic statewide recount were not enough to win a court challenge to change the outcome. Kloppenburg said she called Prosser before her morning press conference to tell him she would not be seeking a court review of the recount, which cut Prosser's approximately 7,300-vote lead by about 300 votes. Prosser won another 10-year term on the state's Supreme Court with slightly more than 50 percent of the 1.5 million votes cast. Kloppenburg picks up about 300 votes but still loses by 7,000.
More than six weeks after the state Supreme Court election, the recount of votes has concluded — and the outcome hasn't changed as incumbent David Prosser defeated challenger JoAnne Kloppenburg by about 7,000 votes. The statewide recount wrapped up on Friday when Waukesha County reported its final totals to the state's Government Accountablity Board. The official totals in that county show Prosser with 92,331 votes, 68 more than were reported in the official canvass report. Kloppenburg had 32,777 votes, 19 more than what what Waukesha County originally reported to the state. All ballots have been counted in state Supreme Court race but waiting on the Board of Canvassers to complete process.
Waukesha County reported 15,249 ballots in the state Supreme recount to the Government Accountability Board as of Wednesday night as the county is nearing an end of the recount that involves 125,070 ballots. The county – which is the last county in the state to complete the recount – has reported 105,141 votes to the election regulation board. However, all ballots have been counted, according to an e-mail from Ellen Nowak, chief of staff for Waukesha County Executive Dan Vrakas. That means about 84 percent of the votes have been reported to the GAB in the recount for the April 5 election between incumbent David Prosser and Assistant Attorney General JoAnne Kloppenburg. The Waukesha County Board of Canvassers has counted about 11,000 votes after 4 1/2 days. Deadline to complete the county's 125,000-vote recount is May 9.
With one week before the recount deadline, Waukesha County has nearly 10% of its votes recounted, resulting in a net change of 12 additional votes for incumbent state Supreme Court Justice David Prosser. The Waukesha County Board of Canvassers had counted about 11,000 of the county's 125,070 original votes cast, as of mid-day Monday. About 48% of all votes statewide had been recounted as of 12:50 p.m. Monday, or 718,230 votes of the approximately 1.5 million cast, according to the state Government Accountability Board. That did not include votes from 27 reporting units that were being reviewed by state elections officials. A three-year delay in federal approval of updated ballot-counting software means the upcoming Supreme Court recount will cost Milwaukee County as much as $500,000 more than it would had the software been approved. The county has had $200,000 in its budget to buy the new software since the purchase was approved in 2008, said Lisa Weiner, elections administrator for Milwaukee County. “We have had to roll over the money for the past three years," Weiner said. "I’m not sure that we will be able to do it again if the software is not approved.” All or parts of 31 of the state’s 72 counties use the same outdated software and are awaiting approval to purchase the same new system. The Waukesha County Democratic Party on Tuesday called on Waukesha County Clerk Kathy Nickolaus to resign, saying she has failed to be transparent and trustworthy in her handling of election results. With Waukesha County Clerk Kathy Nickolaus announcing she made an error on election night, which flipped the results of the Wisconsin Supreme Court race to favor incumbent Justice David Prosser, some residents are asking questions as to how often this happens. But for Nickolaus this isn’t the first time she has found herself embroiled in controversy. In 2010, Nickolaus and Waukesha County Board Chairman Jim Dwyer and county Department of Administration officials feuded about an audit of her election system.
