Too Drunk To Finish Sobriety Tests, Man Charged With 5th OWI

James R. Kuehn, 47, of Hartland, was arrested for felony drunken driving in Sussex on Friday.

A 47-year-old Hartland man who was yelling at another driver in a roundabout in the Town of Lisbon is now facing a felony drunken driving charge.

James R. Kuehn was charged Friday in Waukesha County Circuit Court with operating while intoxicated-fifth offense. If convicted, he faces up to three years in prison and $10,000 in fines.

Kuehn yelled at the driver in the roundabout and was traveling too closely, nearly rear-ending the other driver, according to a criminal complaint.

The other driver told deputies Kuehn later was traveling 100 mph and swerving on Highway 164.

Kuehn was pulled over in Sussex by Waukesha County deputies at 2:18 a.m. Friday near Indian Grass Lane and Main Street. He denied driving fast and told deputies he thought he was following a friend. He also admitted to being drunk, according to the complaint.

“I don’t know why I have to do these tests,” Kuehn told the deputy. “I’m already (expletive).”

Kuehn failed part of the test, said he was too drunk to finish and quit the test, according to the complaint.

Kuehn previously was convicted of drunken driving in 1989, 1991, 1994 and 2008.
