Sussex Man Charged With Felony OWI

Suspect was caught after driving recklessly on I-94 Tuesday evening without his headlights even on.

A Sussex man is facing felony drunk driving charges after he was spotted driving recklessly on westbound I-94 Tuesday evening with no headlights on.

Mark S. Eberle, 55, was charged in Wednesday with one count of fourth offense operating while intoxicated within five years. If convicted, he faces up to six years in prison and $10,000 in fines.

According to the criminal complaint:

At 8:15 p.m. Tuesday, a Waukesha County sheriff’s deputy was alerted to a reckless vehicle on westbound I-94 and Moorland Road. Several witnesses said the car was driving recklessly and almost hit other motorists.

The car got off the expressway at Redford Boulevard in the City of Pewaukee and went northbound until it was pulled over by the deputy near Capitol Drive. Eberle was driving the car and had slurred speech.

Eberle was previously convicted of OWI in 1998, 2008 and 2010.

Eberle was asked to perform field sobriety tests, but he refused due to a past stroke. He then told the officer he had been drinking beer. He began to take an eye test, but then stopped, telling the officer he wouldn’t pass. He was arrested and taken in for a blood test.

Eberle was previously convicted of OWI in 1998, 2008 and 2010. He’s currently being held in Waukesha County Jail on $500 bail.
