A Sussex man is facing charges after authorities say he was pulled over while driving drunk with a 16-year-old and 13-year-old in his vehicle.
Daniel E. Skinner, 49, was charged in Waukesha County Circuit Court Thursday with one count of first offense operating while intoxicated and one count of operating with a prohibited alcohol concentration with a minor in the vehicle. If convicted, he faces up to one year in prison and $2,200 in fines.
According to the criminal complaint:
At 8:13 p.m. July 1, an off-duty Dodge County sheriff’s deputy spotted Skinner’s vehicle on Highway 164 near Capitol Drive, and began to follow it when he noticed the driver was unable to stay in his lane and also emptied a beer bottle out of the window.
The off-duty deputy called police, who pulled Skinner over near Prospect Circle on Highway 164. When asked if he had been drinking, Skinner told the officer he had three beers around 3 p.m.
When asked why he had emptied a beer bottle out the window, Skinner said he had been urinating in the bottle and dumped it on the roadway after it became full.
The complaint states Skinner failed a field sobriety test and had a blood alcohol level of 0.13 at the time of the incident.
Skinner remains free on a $1,000 signature bond while awaiting trial.
