Sussex Woman Charged After Passing Bad Checks For Gas
Suspect had passed three bad checks at Quick Corners and then left without paying the fourth time she tried.
A Sussex woman is facing charges after she allegedly passed several bad checks for gas at an area gas station.
Jodi A. Kubek, 43, was charged in Waukesha County Circuit Court Tuesday with one count of theft and three counts of issuance of a worthless check. If convicted, she could face up to three years in prison and $40,000 in fines.
According to the criminal complaint:
On Sept. 22, Kubek pumped $51 worth of gas into her vehicle at Quick Corners, W232N6116 Waukesha Ave., and attempted to pay the clerk with a check, however, was told she had passed three other worthless checks at the store and would have to pay cash.
She then told the clerk she would be right back and then left.
Kubek is scheduled to make her initial appearance on court Jan. 9

So does this become a crime whenever the bank arbitrarily decides to stop offering their "overdraft protection"?

Check her CCAP....she KNEW she was doing this, so yes that's a crime. If you've written three bad checks to one establishment, I think you have a pretty good idea that you're out of money before you've written the fourth. Not to mention the theft of $51 worth of gas.
