Sussex Man Facing Charges After Driving Drunk With Blood on His Forehead in Waukesha
Suspect told police he had a fight and knew he drank too much before driving.
A 23-year-old Sussex man is facing multiple charges after he got caught driving drunk in Waukesha with blood on his forehead after he got into a fight earlier in the night.
Sergio R. Diaz was charged in Waukesha County Circuit Court Wednesday with one count of second offense operating while intoxicated, one count of operating a motor vehicle after revocation of his license and one count of bail jumping. If convicted, he faces up to two years in prison and $13,600 in fines.
According to the criminal complaint:
A Waukesha police officer spotted Diaz driving at a high rate of speed on westbound Summit Avenue in Waukesha early Wednesday morning and began to follow him. He noticed Diaz continually swerved over the fog line on the road, he then pulled him over.
Diaz had slurred speech and blood above his eyes, which he told the officer was from a fight earlier in the evening. When asked how much he had to drink, Diaz simply said “a lot” and told the officer he shouldn’t be driving.
Diaz then told the officer he just wanted to take a breath test because he had been arrested before for drunk driving and he knew he wouldn’t pass the field sobriety tests. He had a blood alcohol level of 0.23 at the time of the incident, which is nearly three times the legal limit to drive in Wisconsin.
Diaz is currently being held in Waukesha County Jail on $5,000 cash bail while awaiting trial.
