A Waukesha woman — having just broken up with her boyfriend — is now facing possible jail time after she was caught with a baggie of marijuana and burnt marijuana cigarettes, according to a criminal complaint.

Marian J. Tomko, 34, was charged Tuesday with possession of marijuana-second offense in Waukesha County Circuit Court. If convicted of the felony charge, she faces up to 1.5 years in prison and $10,000 in fines.

According to the complaint:

Tomko’s ex-boyfriend arrived to work at Quad/Graphics, N61-W23044 Harrys Way, at 7 a.m. Feb. 18 and parked his vehicle in the lot. He checked on the vehicle at noon and it was still there. But at 4 p.m., he noticed his vehicle was gone.

The man told police he had broken up with Tomko, who had his truck’s key, a few days earlier. The man asked her to return the key, but she refused.

A Waukesha County deputy checked the lot multiple times, waiting for Tomko to return the vehicle. When she did return the truck, she told the deputy she had her ex-boyfriend’s permission to use the vehicle. However, because she had outstanding warrants, she was arrested.

The deputy located a baggie of marijuana and burnt marijuana cigarettes in Tomko’s purse.

Tomko previously was convicted of felony possession of marijuana in Milwaukee County.
